1. Introduction
SVG.io respects the intellectual property rights of others and expects its users to do the same. This DMCA Policy outlines the process for submitting copyright infringement notifications and the steps svg.io takes in response to such notices.
2. Infringement Notifications
If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible through the Service, you are encouraged to notify svg.io in accordance with the Digital Millennium Copyright Act ("DMCA"). The notification must include:
- A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Identification of the copyrighted work claimed to have been infringed.
- Identification of the material that is claimed to be infringing and information reasonably sufficient to permit svg.io to locate the material.
- Your contact information, including address, telephone number, and, if available, an email address.
- A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
3. Procedure for Handling Copyright Infringement Claims
Upon receipt of a valid infringement notification, svg.io will promptly remove or disable access to the infringing material and notify the user who posted it.
4. Counter-Notification
If a user believes that the material removed or to which access was disabled was not infringing, or the user believes that they have the right to post and use such material from the copyright owner, the copyright owner's agent, or pursuant to the law, the user may send a counter-notification containing the following information:
- The user's physical or electronic signature.
- Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled..
- A statement under penalty of perjury that the user has a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material.
- The user's name, address, telephone number, and, if available, an email address, and a statement that such person or entity consents to the jurisdiction of the Federal Court for the judicial district in which the user's address is located, or if the user's address is outside of the United States, for any judicial district in which svg.io may be found, and that the user will accept service of process from the person who provided notification of the alleged infringement.
5. Removal of Content
SVG.io will take appropriate action in response to valid infringement notifications and counter-notifications, including, where applicable, removing or disabling access to content claimed to be infringing.
6. Modification of DMCA Policy
SVG.io reserves the right to modify this DMCA Policy at any time.
